Evicting the Same Tenant Twice: When “Voiding” an N4 Backfires

At some point, every LTB paralegal ends up evicting the same tenant twice. For me, that didn’t take long. The tenant we evicted in June 2025 found a new place, paid first and last, and moved in.
With the new landlord, things didn’t work out from the start, and in his view, not paying rent was only fair.
This case is interesting for two reasons.
First: the tenant paid the amount listed on the N4 just a few hours before the termination date. Proud of himself and how “cleverly” he outplayed the landlord and their paralegal, he was sending emails giving us a couple of days to withdraw the application - or else, according to him, we’d be paying costs.
What he didn’t realize is that by that time, a new rent period had already come due. Which means that to void the N4, he had to pay not just the amount on the notice, but the new rent as well.
In the end, he outsmarted himself and lost $2,600 that any “self-respecting” professional tenant would have kept.
Second interesting point: he asked for a chance to enter into a payment plan.
To avoid that, you need to show the tenant won’t be able to pay. We asked about his income, his expenses, and so on.
And then I asked whether he had paid his previous landlord under an LTB order.
He really didn’t like that question - responded along the lines of “none of your business” and gave no clear answer.
That was all I needed.
